postheadericon Twitter Makes The Case That Trolls Should Have To Pay Legal Fees For Bogus Lawsuits

Last year, I wrote about how ridiculous Twitter has won a lawsuit against a patent attorney Dinesh Agarwal, who claims to have patented "method A system for creating a virtual community of famous people interactive", also known as behalf of the United States patent 6,408,309. jury noted that Twitter does not seem to affect everything, which is very common in such cases. At least it was nice to see Twitter ready to fight. How it works is patent trolls who drag usually much cheaper than paying to disappear than actually fight in the courts. Ben Lee on Twitter writing about how ridiculous it is, and suggesting that it is time to address this aspect of the system:
According to the American Intellectual Property Law Association (AIPLA) 2011 survey, a patent litigation costs on average between $ 900,000 to $ 6,000,000 to defend. In the last month and a half, Twitter has received three new lawsuits patent trolls. Currently, the law allows us to recover millions of dollars in fees to defend - or compensate for the time spent by Twitter employees who worked on the case. The law allows us to ask certain types of misdemeanor charges, so that the court could not order this particular patent troll pay us $ 10,447.85.

Lee is written specifically to try to get support from the SHIELD Act, they wrote earlier this month, which would companies to ask their lawyers to pay costs in cases like this, where there was no basis for the trial at all. This bill started collecting a little attention, and it is doubtful if it will go anywhere this year, hopefully next year the new Congress, there will be enough interest in setting that at least a small part of the patent system. I have not seen a reasonable explanation of why this bill is a problem because it would only affect patent lawsuits completely false
