postheadericon A Look At Three Popular Sites That May Be In Trouble Under SOPA

The EFF is a look at some sites may face serious legal problems and liability for the SOUP right now, especially looking at Etsy, Flickr and Vimeo. These three sites are very popular and useful than most people no doubt believe they are and should be perfectly legal. However, in the soup, which could be declared "dedicated to the theft of goods from the United States", thanks to the broad definition of the law. Etsy Take, for example:

Etsy is an online marketplace for goods in hand, where users can install and create lists of things they did. There are over 800,000 active "shops" full of handmade products - too many Etsy to control manually. Moreover, because of the eclectic nature of the subject property, it is technically difficult to filter through the list items.

This means simply not feasible to Etsy proactively to prevent ads that may be perceived to violate the copyright of the United States trademark law or. This is a problem because in the soup, somebody who is a "holder of a right of intellectual property involved in the activities" of the same part of the site could serve as payment processors Etsy with a note that the force to stop Etsy service within 5 days. This means that the trademark infringement in one of the stores could result in suspension of payments on the site. Contrary to the DMCA, which should be directed to specific offenses, suspension of payment of suppliers is likely to focus on all accounts. And even if the events of Etsy, the provisions of the bill vigilante who was granted immunity in case of choking if a site they have a "reasonable" belief that a part of a violation of the permit site, giving payment processors is a strong incentive to reduce anyway.
Supporters soup
insist that our comments on Etsy should have chosen a business model that is not based on the offense. Show a little off here, right? Etsy Business model has nothing to do with offense ... and that is the problem with the soup.

Flickr, of course, is one of the most popular photo hosting sites. However, in soup, which is at risk:

Like Etsy, Flickr takes copyright seriously, and responds to the DMCA safe haven to take pictures when it receives a valid complaint, the establishment of a political recidivist behavior, and so on. But do not proactively monitor content generated for breach of copyright. The language of SOPA is vague enough that the copyright owner or entity may request this lack of control as "... deliberate actions taken to prevent the confirmation of the high probability of use ... to perform the acts which constitute a violation. "Flickr uses an ad network to advertise and accept payment for premium accounts. The two sources of income could be suspended a few days by a single complaint, and the process of recovery can be long and complex.
Vimeo is a very interesting, since the company was sued by EMI for "inducing" infringement by popularizing "lipdub" videos. As indicated by EFF, which is more than enough to have to close entirely to SOPA.
course, it is unlikely that rights holders will be paid after one of these sites
