Failed Company, Now Patent Troll, Sues Apple Over Transferrable Playlists For A Third Time
After winning the trial (and both parties appeal the ruling parties), Personal Audio prosecuted a second time, saying that the other products Apple has also violated the first ('076) patent. The trial was put on hold until the call to action was first tried. But with the release of IOS5, Personal Audio wasted no time in pursuing Apple once again, bringing the '178 patent in the ball game. As the blog Patent Examiner stated:"The USB cable does not meet the definition of [the judge] to "download" "said the lawyer Ronald J. Personal Audio Schutz of Robins, Kaplan, Miller & Ciresi. "Apple has argued that the USB hard drive iPod making stupid."
The difference in the case again? It's as simple as a USB cable. The patent in question is a "program to distribute audio and reading" the list of downloads. At that time, Apple products named in the lawsuit must first be connected to a computer to sync with iTunes playlists, and Judge Ron Clark, the Eastern District of Texas ruled that Apple did not infringe the patent, even if the jury found otherwise.
But with the launch of new Apple iOS 5 software, iPhones, iPods and iPads can synchronize iTunes playlists via a WiFi connection instead of using a USB cable.
