Rick Falkvinge recently together an excellent post debunking ten of the most common myths you hear about patents. Here 'sa taste:

Myth 2: Patents promote innovation.

Fact:Patents promote innovation not, they Ban Innovation. A patent is by its very definition , Something that the whole world except the patent holder prohibitions of certain building and improving on an innovative step. If patents drive innovation, which is claimed, then this total ban must be shown to cause side effects that are driving the kind of innovation to a greater extent than the extent to which the ban on direct destroyed. No such side effects have switched to exist.

On the contrary, patents are used by established industries to shut down unwanted competition. Instead of competing with better products and services, the current king-of-the-hill, there are cheaper competitors expensive lawyers. This does not promote innovation, nor a healthy competition.

Other myths are debunked claims that investors won 't without patents, the patents are to invest a meaningful measure of innovation that the problem with patent trolls, patents reveal that innovation, and a few others. It 's really a fantastic read. It would 't change the minds of the involved patent system supporters, but for everyone in these debates, it' won \ sa very simple and straightforward debunking of many of the common myths about the meaning of the patent system.
